Texting While Operating a Motor Vehicle under C.R.S. 42-4-239
Effective August 8, 2009, Colorado Statute §42-4-239 states the following:
- Individuals less than eighteen (18) years old are prohibited from using wireless telephones while operating a motor vehicle;
- Individuals eighteen (18) years or older are prohibited from using a wireless telephone to engage in text messaging or other forms of manual data transmission or entry while operating a motor vehicle.
Neither of these restrictions will apply when an individual uses a wireless telephone for the following reasons:
- The individual uses the wireless telephone to contact a public safety entity; or
- During an emergency.
Any individual who violates this statute commits a class A traffic infraction. This category of infraction carries a fine of $50. For individuals with a second or subsequent violation of this statute, the fine is increased to $100.
